General Oladipo Diya’s ‘Clear Case of Setup’ Statement Recalled Following His Death

The recent passing of General Oladipo Diya has brought renewed attention to his famous declaration of a “clear case of setup” during his 1998 trial for alleged involvement in a 1997 coup attempt. Diya, who served as Chief of General Staff under the late Head of State, General Sani Abacha, was a central figure in the controversial Special Military Tribunal.

The trial, presided over by Major General Victor Malu, was held in camera in Jos, Plateau State, and was subject to intense security. According to records from the time, Diya, when asked by Malu if he had anything to say, delivered a bombshell statement that challenged the entire proceeding.

Diya reportedly questioned the absence of General Ishaya Bamaiyi, the then-Chief of Army Staff, from the list of the accused. He is quoted as asking, “Where is the Chief of Army Staff, General Bamaiyi, the mastermind, the planner and the executor of the coup?” Diya then concluded with the now-famous words, “I am not surprised, this is indeed a clear case of setup.”

This statement became a global news headline, reportedly shaking the foundation of the Abacha regime and casting a shadow of doubt over the credibility of the trials. Although Diya was subsequently sentenced to death, his life was spared following the sudden death of General Abacha in June 1998. He was later pardoned and released by General Abdulsalam Abubakar, who took over leadership.

General Diya’s death was announced yesterday, March 26, 2023, marking the end of a life that included a dramatic and pivotal moment in Nigeria’s political history. He lived quietly for 25 years after his release.
